New Subdivision Submission Process
MLS BCS – Official Procedure
Overview
Any subdivision that meets both of the following conditions must be submitted for approval through the New Subdivision Submission Form:
- Contains four (4) or more units
- Is registered or marketed under the same subdivision name
Before submitting, the Broker must confirm that:
- The subdivision meets the MLS BCS definition of a subdivision.
- The subdivision has not already been registered in the MLS BCS system.
- All required documentation is available and unredacted.
- The Broker is authorized to represent the developer or seller.
The Broker must complete the New Subdivision Submission Form available on the MLS BCS website. The form will require the following basic information:
- Subdivision name (official project name)
- Property type Condos, Houses, Land, Commercial, Multi-Family, or Fractional
- Location details Zone · Area · Community · Subdivision
- Development status Pre-construction / New to market — or — Completed / Resale subdivision
- Broker and agency contact information
All documents must be uploaded together through the form. Incomplete submissions will not be processed.
Mandatory Documents — Pre-Construction or New to Market
- Exclusive Listing Agreement (MLS BCS approved format)
- Articles of Incorporation (Acta Constitutiva) of the developer Or government-issued ID if the developer is an individual
- Constancia de Situación Fiscal Issued within the last 90 days
- Power of Attorney If the legal representative authority is not included in the Acta Constitutiva
- Approved Site Plan Issued by Dirección General de Desarrollo Urbano or Dirección de Obras Públicas. Must clearly show unit/building distribution.
- Uso de Suelo
- Construction License With official seal from Dirección de Obras Públicas or Dirección Municipal de Licencias de Construcción
- Formal declaration or proof of the official project name
- Copy of the registered property title Escritura or Fideicomiso
Older or Completed Subdivisions (Resale)
If the subdivision is completed and being sold as resale inventory, the Broker must submit:
- All available documents from the list above
- A site location map clearly showing the subdivision perimeter and access roads
MLS BCS may request additional documentation if needed to properly identify the subdivision.
At the time of form submission, the Broker must pay a non-refundable fee:
- Payment is required to begin review.
- Submissions without payment will not be processed.
- The fee covers administrative review, verification, system configuration, and subdivision registration.
Once the submission is received, MLS BCS will review all documents for:
- Completeness
- Legal compliance
- Consistency with MLS BCS Operating Policies and Procedures
MLS BCS may request clarifications or additional documentation. Review time may vary depending on complexity and completeness of the submission.
Upon approval:
- The subdivision name will be officially added to the MLS BCS FLEX system.
- The correct Zone / Area / Community / Subdivision relationships will be enabled.
- The Broker will receive confirmation that the subdivision is approved and active in the system.
After approval notification:
- Individual properties must be entered into FLEX MLS within 48 hours
- Listings must comply with all MLS BCS rules regarding: property type, status, pre-construction designation (if applicable), and photo and disclosure requirements.
Important Compliance Notes
- Listings within a subdivision may not be listed outside that subdivision.
- All properties must be entered as individual listings, subject to inventory percentage rules for developers.
- Failure to follow this process may result in: listing removal, fines, or suspension of MLS privileges.
