Standard MLS Listing Agreement

The MLS BCS successfully registered its Professional Listing Agreement, a standardized contract that includes the clauses required by local regulations and the MLS operating policies. The agreement establishes clear rules for listing properties, including a minimum listing term of six months and the events under which a broker earns a commission.

One of the most important provisions is the mandatory escrow clause, which requires that commissions be paid directly from escrow. This protects agents and brokers by ensuring commissions are automatically distributed to all participants in the transaction.

The MLS created two standard listing agreements. The Professional
Registered Listing Agreement is used when selling Mexican residential
property owned by a Mexican citizen or Mexican entity in order to comply with NOM-247 regulations. For other property types such as land, commercial properties, or fideicomiso properties, the MLS Standard Listing Agreement is used instead.

All MLS member agencies are authorized to use these contracts through a formal process that includes a power of attorney granted by the MLS. The goal is to ensure consistent documentation, stronger legal protection, and professional standards across the real estate market.
